1. ACCEPTANCE OF TERMS
• By accessing or using THATSAPI, you confirm that you have read, understood, and agreed to these Terms.
• If you do not agree, you must stop using the platform immediately.

2. NATURE OF SERVICE
• THATSAPI is a technology service provider offering WhatsApp Business API, messaging automation, and communication tools.
• THATSAPI DOES NOT send messages on behalf of users.
• Users manage all campaigns, contacts, templates, and message content.
• THATSAPI does not provide marketing lists, leads, or contact data.

3. USER ELIGIBILITY
Users must:
• Be at least 18 years old
• Provide accurate business and contact information
• Complete all required KYC verification
• Use the platform only for lawful and compliant activities
Fake identities or KYC fraud will result in immediate account termination.

4. USER RESPONSIBILITIES (INCLUDING YOUR ADDITIONAL CLAUSES)
• Users must use the Platform only for lawful purposes.
• Users must follow all Meta WhatsApp Business, Messaging, and Commerce Policies.
• Fraudulent, deceptive, or misleading marketing practices are strictly prohibited.
• Users must ensure messages are sent only to contacts who have provided explicit opt-in consent.
• Users are responsible for protecting their data, contact lists, and messaging content.
• Users are responsible for ensuring that their campaigns comply with all applicable Indian data privacy laws.
• Users must comply with all WhatsApp API rules to avoid WABA suspension or business account restrictions.

5. ACCOUNT SECURITY (YOUR ADDITIONAL CLAUSE)
• Users are solely responsible for safeguarding their login credentials, API keys, webhooks, and authentication details.
• THATSAPI is not responsible for unauthorized access caused by user negligence.
• Users must notify THATSAPI immediately if they suspect unauthorized access or security breaches.

6. PAYMENTS AND BILLING (YOUR ADDITIONAL CLAUSE)
• All fees are prepaid and must be paid on time.
• Failure to pay may result in account suspension or service interruption.
• No refunds are provided for misuse, suspension, or policy violations.
• Chargeback misuse will result in permanent account termination and possible legal action.

7. PERMITTED USE OF SERVICES
Users may use THATSAPI for:
• Order notifications and status updates
• OTP and verification messages
• Customer service replies
• Lead nurturing (opt-in required)
• Promotional campaigns using approved WhatsApp templates

• Automation workflows and API integrations approved by Meta

8. PROHIBITED ACTIVITIES (STRICT POLICY)
The following activities are strictly prohibited:
• Messaging non-opt-in users
• Using purchased, scraped, or illegally collected databases
• Sending spam, bulk unsolicited messages, or deceptive campaigns
• Fake loan offers, job scams, crypto promotions, gambling, or financial fraud
• Adult content, explicit media, or obscene material
• Political or religious propaganda
• Hate speech, threats, or violent content
• Misusing WhatsApp templates or bypassing Meta rules
• Impersonation of brands, companies, or government entities
Violations may lead to immediate suspension without refund.

• Any misuse of personal data by users is solely the user’s responsibility.
• THATSAPI is not liable for data misuse, unauthorized uploads, or illegal messaging by users.

10. COMPLIANCE WITH META POLICIES (YOUR ADDITIONAL CLAUSE)
• Users must follow all Meta WhatsApp Business API rules, template policies, commerce restrictions, and advertising guidelines.
• Violations may lead to the user's WABA being restricted or permanently suspended by Meta.
• THATSAPI is not responsible for Meta enforcement actions or number bans caused by user violations.

11. ACCOUNT SUSPENSION AND TERMINATION
We may suspend or terminate accounts without notice for:
• Spam, fraud, or illegal activities
• High complaint rates or poor WhatsApp quality rating
• Violation of Meta or Indian laws
• Payment issues or chargeback fraud
• Security threats or suspicious activity
Suspended accounts are not eligible for refunds.

12. ZERO LIABILITY CLAUSE
THATSAPI is not responsible for:
• Message content sent by users
• Contact lists uploaded by users
• Number bans or Meta enforcement actions
• User-generated illegal or harmful content
• Loss of business or financial losses
• Third-party downtime (Meta, hosting, payment gateway)
Users accept full legal responsibility for their actions.

13. DISCLAIMER OF WARRANTIES
• Services are provided "as-is" and "as available."
• THATSAPI does not guarantee WhatsApp approval, message delivery, or API uptime.
• THATSAPI is not responsible for changes made by Meta.

14. LIMITATION OF LIABILITY
• THATSAPI's liability is limited to the amount paid by the user for services during the last billing cycle.
